Terms of Service
Effective October 12, 2026
These terms are an agreement between you and Ben Eves, doing business as Moxie Marine Technology ("Moxie", "we"), which operates moxieyacht.com and moxieyachting.com. By creating an account or using Moxie, you agree to them.
1. What Moxie is
Moxie gives a boat a permanent digital identity: an MXE number, a weatherproof badge for the boat, and a vessel record you manage. The record stays with the boat, not the owner, and can be transferred when the boat is sold.
Moxie is a private record-keeping service. It is not a government registration, title, or U.S. Coast Guard documentation, and it does not replace any document you are legally required to hold or carry aboard. Keep your originals.
2. Accounts
You must be 18 or older to create an account. You agree to give accurate information, keep your password secure, and tell us promptly at support@moxieyachting.com if you think your account has been accessed without permission. You are responsible for activity under your account.
3. Registering a vessel
You may register only a vessel you own or are authorized by the owner to register. You are responsible for the accuracy of everything you enter.
Some details are locked once registered, including the hull identification number (HIN) and year of build. A record that can be freely rewritten isn't a reliable record. If a locked detail is wrong, contact support with supporting documentation and we will review it. We may decline corrections we can't verify.
4. MXE numbers and badges
Each vessel receives an MXE number that is permanent and never reissued, including after a vessel is decommissioned. The MXE number and badge identify the vessel, not you, and they stay with the vessel on transfer.
Each vessel comes with two identical badges: one to affix aboard and one to keep as a spare. You are responsible for affixing the badge and for its placement. Replacement badges come in pairs for $29, including shipping, plus any applicable sales tax. To order, email support@moxieyachting.com with your MXE number. Your MXE number never changes, so replacements are identical to the original.
5. What others can see
Anyone who scans your badge sees the vessel's public profile. It does not include your documents or your contact details. See the Privacy Policy for exactly what it shows.
You can share more through share links you create, and through access you grant to a marina. You control those, and you can revoke them at any time. You are responsible for who you share with.
6. How Moxie looks, and partner content
We may change the design, layout and features of Moxie at any time, including how vessel profiles look and what they show.
Vessel profiles, including the public profile, may show content placed by Moxie that you don't control. This includes a credit to the dealer or broker that delivered or sold the boat, and other partner content. Where a partner pays for a placement, we label it as partner content. Partner content never includes your personal information, and placing it doesn't give the partner access to your account, documents or contact details.
7. Documents and service records
You can store vessel documents such as registration, insurance and boater card. Full Access also lets you keep a service history for the vessel, with optional attachments such as invoices. You keep ownership of everything you upload. You give us permission to store, process and display it only as needed to provide Moxie to you and to the people you choose to share with.
Expiry status (current, expiring soon, expired) is based on the dates you enter. It is informational only. Keeping your documents current is your responsibility.
8. Plans, fees and renewal
Moxie offers paid plans billed annually, plus one-time fees such as the badge fee and the transfer fee. Current prices are on the pricing page. Prices don't include any applicable sales tax. Payments are processed by Stripe; we do not store your card details.
Plans renew automatically each year at the then-current price, charged to your payment method on file, until you cancel. You can cancel online from your account at any time, with no need to call or email us. Cancellation takes effect at the end of the paid period, and you won't be charged again.
Renewal reminders. Before each annual renewal, we'll email you a reminder at least 15 and no more than 45 days ahead, telling you what renews, the amount, the date and how to cancel. If we change a plan's price, we'll tell you before the new price applies to your renewal, along with how to cancel.
Included and complimentary plans. A plan may be included with a boat by the dealer that delivered it, or given to you by Moxie. An included plan belongs to the boat and passes to the next owner if the boat is sold during the included period. A complimentary plan belongs to your account. Neither renews automatically or charges you; when one ends, you can choose a paid plan. We'll remind you in the app before an included or complimentary plan ends.
The transfer fee is charged to the seller when the buyer accepts a transfer. Nothing is charged if a transfer is never accepted.
Refunds. You can cancel a new subscription within 14 days for a full refund, as long as your badge hasn't shipped. Nothing that has shipped is refundable, including badges and replacement badges. Transfer fees are non-refundable once the buyer accepts.
9. Selling or transferring a vessel
The seller starts a transfer to the buyer's email address, and the buyer accepts. On acceptance, the vessel's identity and vessel-level details, including the registration document and its number, state and expiry, and the vessel's service history, move to the buyer. The registration document may show the seller's name and address, as it would in any boat sale. Attachments to service records, the seller's personal information, personal documents and share links do not move. The seller keeps a read-only copy of the record as it stood on the day of transfer.
Moxie records the transfer of the digital record only. It does not transfer legal title, and it is not evidence of ownership.
10. Decommissioning
You can decommission a vessel that is permanently out of service. The record is archived and the MXE number is retired permanently.
11. Acceptable use
You agree not to:
- register a vessel you have no right to register, or enter false information about a vessel;
- upload content that is unlawful, infringing, or not yours to share;
- access or attempt to access another person's account, vessel records or documents;
- interfere with, probe, or overload the service, or use automated means to create accounts or scrape data;
- remove, copy or reuse another vessel's badge to misrepresent a vessel.
We may suspend or close accounts that break these terms.
12. Our intellectual property
Moxie's software, design, badge design and brand, including the names Moxie and Digital Dry Bag™, belong to us. These terms give you a personal, non-transferable right to use the service; they don't transfer any of our rights to you.
13. Ending your account
You can close your account at any time by emailing support@moxieyachting.com. We may suspend or terminate access if you break these terms or if required by law. Because MXE numbers and vessel records belong to the vessel, the vessel's identity may be retained after your account closes, without your personal information. See the Privacy Policy.
14. Disclaimers
Moxie is provided "as is". We work to keep it available and accurate, but we don't guarantee it will be uninterrupted or error-free, that offline copies will be current, or that information entered by owners is accurate. Do not rely on Moxie as your only copy of any document.
15. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost data or profits. Our total liability for any claim is limited to the amount you paid Moxie in the 12 months before the claim. Some of these limits may not apply to you under California law.
16. Indemnity
You agree to cover our reasonable costs from claims arising from content you upload, vessels you register, or your breach of these terms.
17. Governing law and disputes
These terms are governed by California law. Disputes will be resolved in the state or federal courts located in Santa Cruz County, California, and you and Moxie consent to their jurisdiction. You may also bring an individual claim in small claims court.
18. Transfer of these terms
We may transfer these terms, and our rights and obligations under them, to Moxie Marine Technology, LLC or another entity that takes over the Moxie business. If we do, we'll tell you by email or in the app. Your account, vessel records, plan, renewal date and price continue unchanged.
19. Changes
We may update these terms. For material changes, we will notify you in the app or by email before they take effect. Continuing to use Moxie after that means you accept the updated terms.
